Summary:
The applicant is seeking a variance to construct an addition 3.75 feet from the east side lot line. The ordinance requires a 7 foot side yard setback in the R-2 District.

Background:
The property is located at 922 5th Street and has an existing single-stall attached garage built 3.75 feet from the side property line. The applicant is proposing to add a double car garage to the south of the existing single stall garage and would like to keep the addition in line with the existing garage to maintain symmetry and prevent the loss of yard space.


Variance Criteria:

1. Due to special conditions, a literal enforcement of the provisions of this ordinance will result in unnecessary hardship, and the variance shall not violate the spirit of the ordinance and substantial justice may be achieved as a result of the variance.

The house was constructed in 1950, prior to zoning regulations beign prevalent in the community. In the central part of the community, it is common to find properties with single stall garages built close to the property line.

2. Unique circumstances apply to the property which do not apply to other properties in the same vicinity or district.

Staff does not find that the property has unique circumstances which do not apply to other properties in the vicinity.

3. The variance is necessary for the preservation of a property right that is substantially the same as that possessed by other owners of other property in the same district.

Staff does not find that a variance is necessary for the preservation of a property right. Many properties in the vicinity have similar property characteristics and have construted detached garages off the alley consistent with the zoning regulations.

4. The variance requested is the minimum variance which would alleviate the hardship.
