Summary:
The applicant is requesting a variance to construct a building within the front and side yard setbacks in an I-2 District

Background:
The property is located at 110 Railroad Street and received a variance to construct a building in 2017. The applicant has made improvements to the property as an older storage building was removed from the property, however, construction of the new shop building did not commence prior to the expiration of the variance. A variance, once approved, must be substantially completed within three years from the date of approval.

The I-2 District requires a 40 foot front yard and 20 foot side yard setback. The variance request is to place the building 20 feet into the 40 foot front yard setback and two feet into the east side yard setback and 5 feet into the west side yard setback. The front lot line is irregular shaped due to the inconsistent right-of-way width of Railroad Street. The west side lot also contains an irregular shape and widens approximately halfway into the lot.


Variance Criteria:
1. Due to special conditions, a literal enforcement of the provisions of this ordinance will result in unnecessary hardship, and the variance shall not violate the spirit of the ordinance and substantial justice may be achieved as a result of the variance.

There is some degree of hardship due to the irregular shape of the lot.

2. Unique circumstances apply to the property which do not apply to other properties in the same vicinity or district.

The lot has a unique "Z" shape along the front lot line and widens abruptly approximately halfway along the west lot line.

3. The variance is necessary for the preservation of a property right that is substantially the same as that possessed by other owners of other property in the same district.
