Summary:
The City of Brookings is seeking an amendment to the zoning ordinance to change the side yard setback from zero (0) feet to five (5) feet in the RB-4, B-2, B-2A, and B-3 Districts to align with the building code and landscape ordinance.
Background:
The building code requires a minimum five (5) foot side yard setback or ten (10) feet between structures. If structures are closer than five (5) feet to the property line, fire rated construction materials are required. In addition, the recently adopted landscaping ordinance requires a five (5) foot side landscape area. This amendment will provide consistency between the side yard setback, building code, and landscape regulations. A five (5) foot side yard setback will also allow a reasonable distance for building maintenance.
The B-1 District will remain as a zero foot setback district. In addition, buffer yards between business and residential districts will be unchanged by this proposed amendment.
Staff Recommendation:
Staff recommends approval of the zoning ordinance amendment.
Planning Commission Recommendation:
The Planning Commission voted 7-0 to recommend approval of the zoning ordinance amendment.
