Summary and Recommended Action:

Staff recommends approval of the proposed resolution which is the final balancing change order for the 2024-08STI Street Maintenance and Overlay Project.  The resolution will increase the contract awarded to Bowes Construction, Brookings, SD, in the amount of $127,664.57 (10%).  The increased amount stems from the unforeseen subsurface conditions in 7^th Street, as well as the addition of 14^th Avenue between 3^rd and 4^th Street due to pavement failure that was deemed imminent.  The change order includes six (6) days of liquidated damages at $475 per day ($2,850) for the days past the final completion date of October 20, 2024. The adjusted contract remains below the original estimate and budgeted appropriations by $113,719.58.
